TMZ has learned R&B sensation Brandy was involved in a fatal accident last month, and it appears to be her fault.

It happened at 10:30 AM on December 30, 2006 on the 405 Freeway in Los Angeles. Law enforcement sources tell TMZ Brandy was driving her 2007 Land Rover at 65 mph and did not notice that cars in front of her had slowed considerably. We're told Brandy's vehicle struck a 2005 Toyota. The Toyota then hit a 1989 Toyota. The 2005 Toyota then slid sideways and hit the center divider. As the 2005 Toyota came to a halt, it was struck by a 1988 Acura.

We're told the driver of the 2005 Toyota, Awatef Aboudihaj, was taken to Holy Cross Hospital in critical condition and she died the next day. Aboudihaj, a 38-year-old married mother of one, was a Los Angeles resident.

Brandy was not injured. The driver of the Acura suffered moderate injuries.

Brandy was not arrested and there is no evidence drugs or alcohol were involved.

Calls to Brandy's reps have not yet been returned.

Police are doing a mechanical investigation of the cars involved in the accident to determine if there was a malfunction.

Brandy's "Moesha" co-star, Lamont Bentley, was killed in January, 2005 when his car plunged off the same freeway. Another "Moesha" co-star, Merlin Santana, was killed by a gunshot wound while sitting in the passenger seat of a car in 2002

Oh my God.

The scary thing is, that same thing very nearly happened to me coming home from work the other day. Of course, I was driving an Astra that's almost older than I am, so I doubt I would have caused as much damage.

I feel really sorry for the family of the person who was killed, and the people who were injured... I also feel sorry for Brandy... how you could live with the guilt of knowing you have killed someone (a mother, no less) is terrible.

:(

OT: That is really spooky about the fate of the Moesha co-stars. I would really stay off the roads if I were Brandy (or anyone else that was on that show, for that matter).

You didn't know?

Yeah, he was shot in the head by some psycho female while sitting in a car coming from a club. I had read that she blew his head off so bad, his face would've been unrecognizable if they didn't know that was his car.:x

Bulletin from Brandy's myspace page:

Brandy wishes to publicly express her condolences to the family of the deceased.

Brandy asks that you respect the privacy of everyone involved at this time.

Brandy Doing Fine After Accident; Finishing New Album. - January 25th, 2007

Yesterday news reports went wild that singer/actress Brandy was involved in a fatal accident. Despite previous reports, the cause of the accident is still under investigation. Brandy was not injured, was not arrested and drugs or alcohol was not involved.

In a statement issued Wednesday, her publicist said Brandy “wishes to publicly express her condolences to the family of the deceased. Brandy asks that you respect the privacy of everyone involved at this time.”

Brandy is doing alright since the accident and is currently in the studio putting the finishing touches on her new album, due out later this year.

It's lucky for Brandy that she was in a massive car like tha

that. Had she been in a little sports car like most celebrities choose to go around in, she could well have been dead:(

If that does happen and she gets a sentence, that would be terrible - imagine not only having to face the guilt of knowing you've killed someone by accident, but to be then sent to prison for it, too.

As you said though, I find it highly doubtful that she will be put in prison because she wasn't under the influence of anything (drugs/alcohol).

Accidents happen unfortunately. We should all learn from this and be extra careful while driving - I know I will be! I've very nearly been in a similar situation a few times!

For those who know the LAw is there a chance??

I mean she obviouslly has admited that She didn't realize the trafic in front of her was slowing down, so basically the accident is her fault!!

But that usually means her insurance company is gonna have to pay for all the damges... RIGHT? or is there a chance because the lady ended up dying that she could be held liable for some form of neglegence manslaughter or something like that????? have there been any cases like that???

Her insurance would pay for the damages after

Brandy meets her deductible, but that is separate from any sort of criminal suit regarding the death. She could surely fall under negligent driving or something. Anytime you rear-end someone it's your fault because it means you were following too close and/or not paying attention.

it seems a bit much

the lawsuit is rediculously high. i could see a max of $5 million. but please... i doubt brandy was like, "oohh lets kill someone." thats why it is an accident. sure she should be penalized, but not at such a high figure.

Im not an expert, but does it vary on

how much you're worth?

I mean, if Joe Bloggs killed someone in the same way, would he be given the same penalty as someone who is obviously extremely wealthy like Brandy? Or is it different for each individual?
